Calling our website / access data

Each time you use our website, we collect the access data that your browser automatically transmits to enable you to visit the website. The access data includes in particular:

  • IP address of the requesting device;
  • Date and time of the request;
  • Address of the website accessed and the requesting website;
  • Information about the browser used and the operating system;
  • Online identifiers (e.g. device identifiers, session IDs).


The data processing of these access data is necessary to enable the visit of the website and to ensure the permanent functionality and security of our systems. The access data is also temporarily stored in internal log files for the purposes described above, in order to compile statistical information about the use of our website, to further develop our website with regard to the usage habits of our visitors (e.g., if the proportion of mobile devices used to access the pages increases) and to generally maintain our website administratively. The information stored in the log files does not allow any direct conclusions to be drawn about your person; in particular, we only store the IP addresses in shortened, anonymized form. The log files are stored for 30 days and archived after subsequent anonymization.


Orders

In the case of an order process (e.g. when ordering brochures), we collect mandatory data necessary for the processing of the contract:

  •  Salutation;
  •  First and last name;
  •  address.


Optionally, information such as e-mail address or telephone number are possible, so that we can contact you in case of queries also on these ways. The legal basis for the processing is Art. 6 para. 1 p. 1 lit. b DSGVO.


Events, photos and videos

If you register for one of our events, we will process the information you provide in the input fields solely for the purpose of running the event (e.g. to enable your participation and to create lists of participants or name badges). The legal basis for this data processing is Art. 6 para. 1 lit. b) DSGVO and Art. 6 para. 1 lit. f) DSGVO to protect our legitimate interests in conducting the event accordingly.

It may happen that we take photos and videos at an event in order to document the event and use them for promotional external presentation (e.g. at events, in info materials, on websites or social media fan pages). If you do not wish to appear in the recordings, you can inform us of this at any time. The legal basis for this data processing is Art. 6 para. 1 lit. a) DSGVO, insofar as the processing is based on your consent, Art. 6 para. 1 lit. b) DSGVO, insofar as the processing is necessary for the performance of contracts and the exercise of rights, as well as Art. 6 para. 1 lit. f) DSGVO for the protection of our legitimate interests to create and use the photos and videos.


Google Maps

Our website uses the map service Google Maps of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google"). In order for the Google map material we use to be integrated and displayed in your web browser, your web browser must establish a connection to a Google server, which may also be located in the USA, when you call up the contact page.

In the event that personal data is transferred to the USA, Google has submitted to the EU-US Privacy Shield. OpenStreetMap

On our website, we use the open source map service "OpenStreetMap" of the provider OpenStreetMap Foundation, St John's Innovation Centre, Cowley Road, Cambridge, CB4 0WS,United Kingdom. Legal obligations of the Tourismusverband Franken e.V. related to the finding and booking of accommodations, vacation packages, guided tours or other services are governed by the current laws governing travel agencies.

The legal obligations between a guest and a service provider are governed by law and, unless specified otherwise, by the General Terms of Business of the service provider (for providers of accommodations this are usually Guest Services Policies and Travel Policies for vacation packages).

The Tourismusverband Franken e.V., merely functions as a service broker and is not responsible for the services offered. The supplier is solely responsible for the services provided.

Events

Event information listed is based on the information provided by local and regional event organizers. The Tourismusverband Franken e.V. is not responsible for this content and its accuracy.

Our websites use the "Ads Conversion Tracking" and "Ads Remarketing" services of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google"). Google AdSense

Our websites use the "AdSense" service of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google"). AdSense is used to display advertisements on our website. We operate a fan page on the social network Meta Platforms, Inc., 1601 Willow Road, Menlo Park, California, 94025, USA ("Facebook") under joint responsibility in order to communicate there with interested parties and followers and to inform them about our products and services. Data sharing

The data collected by us will only be passed on if:

  • you have given your express consent in accordance with Art. 6 para. 1 p. 1 lit. a DSGVO;
  • the disclosure is necessary in accordance with Art. 6 (1) p. 1 lit. f DSGVO for the assertion, exercise or defense of legal claims and there is no reason to assume that you have an overriding legitimate interest in not having your data disclosed;
  • we are legally obliged to disclose your data according to Art. 6 para. 1 p. 1 lit. c DSGVO; or

Part of the data processing may be carried out by our service providers. In addition to the service providers mentioned in this privacy policy, this may include, in particular, data centers that store our website and databases, IT service providers that maintain our systems, and platforms for online booking of accommodation businesses or mailing providers. If we pass on data to our service providers, they may only use the data to perform their tasks. The service providers have been carefully selected and commissioned by us. They are contractually bound to our instructions, have appropriate technical and organizational measures in place to protect the rights of the data subjects, and are regularly monitored by us.


Duration of storage

In principle, we store personal data only as long as necessary to fulfill contractual or legal obligations for which we collected the data. Thereafter, we delete the data immediately, unless we still need the data until the expiry of the statutory limitation period for evidence purposes for claims under civil law or due to statutory retention obligations.

For evidentiary purposes, we must retain contractual data for three years from the end of the year in which the business relationship with you ends. Any claims become statute-barred at this point at the earliest in accordance with the standard statutory limitation period.

Even after this, we still have to store some of your data for accounting reasons. We are obliged to do so because of legal documentation obligations that may arise from the German Commercial Code, the German Fiscal Code, the German Banking Act, the German Money Laundering Act and the German Securities Trading Act. The periods specified there for the retention of documents are two to ten years.


Your rights

You have the right to request information about the processing of your personal data by us at any time. When providing information, we will explain the data processing to you and provide you with an overview of the data stored about your person.

If any data stored by us is incorrect or no longer up to date, you have the right to have this data corrected. You can also request the deletion of your data. If deletion is exceptionally not possible due to other legal provisions, the data will be blocked so that it is only available for this legal purpose.

Right of revocation and objection

  • "_ga" for 2 years and "_gid" for 24 hours (both used to recognize and distinguish website visitors by a user ID);
  • "_gat" for 1 minute (to reduce requests to Google servers);
  • "IDE" for 13 months, if applicable (third-party cookie to recognize and distinguish website visitors by a user ID, to record interaction with advertisements and in the context of playing out personalized advertisements).


We have concluded an order processing agreement with Google for the use of Google Analytics as well as standard contractual clauses in the event that personal data is transferred to the USA or other third countries.

Online presence in social networks

We maintain online presences in social networks in order to communicate there with customers and interested parties, among others, and to provide information about our services and offers.

The users' data is generally processed by the social networks concerned for market research and advertising purposes. In this way, usage profiles can be created based on the interests of the users. For this purpose, cookies and other identifiers are stored on the users' computers. Based on these usage profiles, for example, advertisements are then placed within the social networks but also on third-party websites.

As part of the operation of our online presences, it is possible that we can access information such as statistics on the use of our online presences, which are provided by the social networks. These statistics are aggregated and may include, in particular, demographic information and data on interaction with our online presences and the posts and content distributed via them. For details and links to the data of the social networks that we as operators of the online presences can access, please refer to the list below.

The legal basis for the data processing is Art. 6 para. 1 p. 1 lit. f DSGVO, based on our legitimate interest in effectively informing users and communicating with users, or Art. 6 para. 1 p. 1 lit. b DSGVO, in order to stay in contact with and inform our customers and to carry out pre-contractual measures with future customers and interested parties.

For the legal basis of the data processing carried out by the social networks on their own responsibility, please refer to the data protection notices of the respective social network. The links below also provide you with further information on the respective data processing as well as the options to object.

We would like to point out that data protection requests can be asserted most efficiently with the respective provider of the social network, as only these providers have access to the data and can take appropriate measures directly. Facebook

The Tourism Association Franconia maintains social media profiles on the social network of Facebook (so-called "Fanpage").

The Facebook social network is offered in each case by Meta Platforms Ireland Ltd, 4 Grand Canal Square, Dublin 2, Ireland ("Facebook").

We regularly share offers, recommendations and similar content on our Fanpage.

  • When you visit our fanpages or other Facebook websites, the operator of the social network records your usage behavior with cookies and similar technologies. We as fan page operator can view general statistics on the interests and demographic characteristics (such as age, gender, region) of the fan page audience. If you use social networks, the type, scope and purposes of the processing of data in social networks are primarily determined by the operators of the social network.
  • When you visit our fan pages, all messages, content and other information that you communicate directly to us there are generally recorded, such as when you post something on a fan page or send us a private message to reciprocate communication with you. Of course, if you have an account with that social network, we may also view your public information, such as your username, information in your public profile, and content you share with a public audience. Note, however, that as the originator of the posts, they independently write posts and messages, which are ultimately within the sphere of Facebook. Facebook acts here as messenger or post and post operator and is thus independently responsible as a messenger service as an OTT service in this function.

  • Something different applies to the data processing described below for usage analysis (page insights); we are jointly responsible for this with Facebook. With every interaction with fan pages, Facebook records the usage behavior of the fan page visits using cookies and similar technologies. On this basis, the fan page operators receive so-called "page insights". Page insights contain only statistical, depersonalized (anonymized) information about visitors to the fan page, which can therefore not be assigned to any specific person. We have no access to the personal data used by Facebook for the creation of Page Insights ("Page Insights data"). The selection and processing of Page Insights data is carried out exclusively by Facebook. With the help of Page Insights, we obtain insights into how our Fanpages are used, which interests the visitors to our Fanpages have, and which topics and content are particularly popular. This allows us to optimize our fan page activities, for example, by better responding to the interests and usage habits of our audience when planning and selecting our content. We and Facebook are jointly responsible for processing your data to provide Page Insights. To this end, we and Facebook have entered into an agreement specifying which company fulfills which data protection obligations under the GDPR with respect to the processing of Page Insights data. We have no influence on these data processing procedures at Facebook. The legal basis, insofar as you have given your consent to Facebook with regard to the creation of page insights described above, is Article 6 (1) (a) DSGVO (consent). The legal basis is otherwise Article 6(1)(f) DSGVO (legitimate interest), whereby our legitimate interests lie in the above-mentioned purposes, i.e. effective information of users and communication with users.
